Reckless Driving:
Reckless driving citations can result in some of the most severe fines and restrictions and therefore should be taken very seriously. Anything from driving 25 miles per hour (or more) over the speed limit to trying to elude a police officer can result in a reckless driving violation. To ensure your protection, an experienced Indiana traffic defense lawyer from the Law Offices of Tony Zirkle can assist you in defending your rights.
Red light and Stop Sign Violations:
All states mandate obedience to traffic control signals and devices, making it necessary for all drivers to observe traffic lights and stop signs. Among the more common traffic violations issued are running a red light or failure to stop at a stop sign.
In most cases, a driver is allowed to make a right turn on a red light; however, if there is posting of “no right turn on red,” the turn then becomes illegal and deemed “running a red light.”
If you have any questions about red light and stop sign violations contact the Law Offices of Tony Zirkle and an experienced Indiana traffic ticket defense attorney will help you.
Illegal U-turns:
A traffic ticket may be given to any driver who makes an illegal or unsafe u-turn. A driver who makes a u-turn at an intersection that has a posted "No U-Turn" sign has committed an illegal u-turn, and may receive a traffic ticket. There may be other circumstances when a U-turn is illegal; for more information contact the Law Offices of Tony Zirkle for an expert opinion from an Indiana traffic ticket defense lawyer.
Restraint Violations:
Indiana traffic law demands the use of safety belts by all adult drivers and passengers in motor vehicles. These Indiana traffic laws are standard enforcement and give an Indiana state officer the right to pull over a driver on grounds of seat belt violation.
Persons of all ages riding in the front seat and children 12 and younger riding in any position are required to wear seat belts. There are some rare exceptions for postal carriers, certain delivery vehicles, school buses and other mass transit vehicles. Children four years old and younger must be in a child passenger restrain system. If it is determined that the child does not fit in such a system, they must be fastened in a seat belt.
If you have any questions about seat belt and child restraint violations contact the Law Offices of Tony Zirkle and an experienced traffic ticket attorney will help you.
Driving without a License, Registration, or Proof of Insurance
In order to operate any vehicle, Indiana traffic law requires three pieces of material. It’s necessary to provide a license, registration, and proof on insurance. Failure to provide one or more of these will result in a traffic violation. If the operator of a vehicle has never been issued a drive’s license and is caught driving, a violation will be issued. Other ways to obtain a traffic violation and an automatic four points on your driving record is by driving on a suspended or permanently revoked license.
If the vehicle has never been registered with the state or if the vehicle’s registration has expired, the driver is in violation of Indiana traffic law. The longer the registration goes without being renewed, the stricter the fines. Failure to address a registration issue may even result in higher insurance.
In order for a vehicle to be registered in the State of Indiana, the owner of the vehicle must have all six necessary documents to obtain the necessary title: assignment of title by seller, odometer statement, vehicles titled in another state, social security and federal employer identification number, requirements for new residents, motor vehicle registration and plates. If you have any questions about these documents or registration, contact the Law Offices of Tony Zirkle where an experienced Indiana traffic ticket defense attorney will assist you.
Indiana traffic law demands that every driver have the capability to pay a certain amount to cover their liability if they are involved in a motor vehicle accident. As such, every driver must provide proof of insurance. Penalties for a first-time offense for driving without insurance range from the imposition of a $100 fine, to a one-year driver's license suspension.
When uncertain about your rights in situations such as this, an experienced traffic defense attorney can assist you in any and all questions. For full protection and representation, call the Law Offices of Tony Zirkle.
